The following terms and conditions apply to the Truckfest truck display giveaway:
The Promoter is Mercedes-Benz Trucks UK Limited (Company Number 10304244) whose registered address is Delaware Drive, Tongwell, Milton Keynes, United Kingdom, MK15 8BA (the “Promoter”).
In these terms and conditions, references to masculine include the feminine and the neuter and to the singular include the plural and vice versa as the context admits or requires.
Headings are used for reference only and do not constitute terms of this contract.
1. The Promoter is providing the opportunity to display the entrant’s truck on the Promoter’s Truckfest Peterborough stand (the “Display Giveaway”) and in exchange the successful entrants will receive:
1.1. Entrants truck, as selected by the Promoter, to be featured on the Promoter’s Truckfest Peterborough stand (“Display Opportunity”)
1.2. Two Tickets to Truckfest Peterborough 2023, these tickets permit entry for two [named] individuals during 29th and 30th May 2023.
1.3. Overnight accommodation for two people on 29-30th May 2023 inclusive.
1.4. A selection of Mercedes-Benz Trucks UK merchandise
2. The Display Giveaway will take place on the following days:
2.1. 31/03/2023-06/04/2023
3. The Display Giveaway will be open when the Promoter publishes a post on the Promoter’s Instagram, Twitter and Facebook (the “Display Post”) and it will close one week after the post date.
4. The Display Giveaway is free to enter and no purchase is necessary.
5. The Display Giveaway is open to all UK residents aged 18 years or over, except employees of the Promoter or its group companies, their families, agents or any third party directly associated with administration of the Display Opportunity. In entering the Display Giveaway, you confirm that you are eligible to do so and eligible participate fully in the opportunity. The Promoter may require you to provide proof that you are eligible to enter the opportunity.
6. To enter into the Display Giveaway you must complete in full the survey posted on the Display Giveaway Post.
7. There is a limit of one entry per person.
8. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
9. For the avoidance of doubt the Display Giveaway will provide the successful entrant, the elements as set out above in clause 1. There is no cash alternative, substitute or alternative prize for the successful entrant as set out in clause 17.
10. The six Display Opportunities will be chosen based on quality of vehicle submitted along with quality of livery and condition of the vehicle from entries received on the survey. The confirmation of the successful entrants shall be conducted by the Promoter and this will be final and not subject to further adjudication .
11. Once the successful entrants have been confirmed, they will be notified via email within 2 days of the Closing Date (“Notification Date”).
12. Once notified the successful entrant must respond and confirm they are eligible to take part and confirm contact details for hotel bookings and logistics of their truck for the Truckfest stand.
13. In the event that the Promoter is unable to make contact with any successful entrant within 48 hours of the Notification Date, the Promoter may reserve the right to to select a new entrant from the remaining entries.
14. The decision of the Promoter regarding any aspect of the Display Opportunity and Giveaway is final and binding and no correspondence will be entered into about it.
15. Any entrant who has provided false or misleading information and/or has breached these terms and conditions will be immediately disqualified from the Display Giveaway.
16. Unsuccessful and disqualified entrants will not be notified.
17. There is no cash alternative available and the Benefit is non-refundable and non-transferable.
18. The Promoter reserves the right to replace the Benefits with an alternative Benefit of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
19. The Promoter reserves the right to withhold any Benefit under these terms and conditions if they have been breached. In the event of breach, the Display Giveaway may be re-opened.
20. The Benefit may not be sold, offered for sale, used for competitions, coupled or bundled with any other product or services, or used for any commercial or promotional purposes whatsoever.
21. The Promoter does not accept any responsibility or liability if the Successful Entrant is not able to take up the Benefit.
22. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then such a clause shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
23. Entry into the Display Giveaway shall constitute your acceptance of these terms and conditions. The Promoter reserves the right to refuse entry, or refuse to award the Benefit to anyone in breach of these terms and conditions.
24. Successful Entrants agree to the use of their name and image in any promotional activity following the Display Giveaway without remuneration.
25. The Promoter reserves the right to withdraw, postpone and/or amend the Display Opportunity and/or the Event at any time without notice.
26. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Successful Entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Benefit except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
27. The Promoter shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, pandemic, epidemic, inevitable accidents, supervening legislation, technical and computer faults, system failures, network errors, website unavailability, hacks on the system, personal computer issues, failures and malfunctions or any other circumstances amounting to force majeure or any other issue out of our reasonable control.

29. The Display Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram, Twitter or Facebook.
30. These terms and conditions shall be governed and construed and have effect in all respects in accordance with English Law and the courts of England shall have exclusive jurisdiction over any proceedings arising out of or in connection with them.
